Notable Music Academy Studio Policy

1. Enrolment Cancellation

To cancel enrolment, provide at least 30 days’ notice. Lessons during the notice period are paid for and attended. There are no cancellation fees, but the 30 days’ notice is mandatory.  If the account was previously placed on hold, the 30-day cancellation notice period begins on the date of reactivation, not the original hold date. No retroactive cancellations or credits will be applied during or after a hold period. Only the person who enrolled the student (the Policy Holder) may request or approve cancellations or changes to the account.

2.1 Cancellation Options & Policy Late Cancellations (Less than 48 Hours’ Notice):

• Video Lesson Recording: Request via the student portal prior to lesson start (“Request LessonMate”).

• Lesson Transfer: Anyone in your household can attend in place of the student, with no prior notice required.

• Cancel Lesson: If none of the above options apply, cancel via the student portal. Cancellations made less than 48 hours before the lesson are forfeited and billed.

- Missed Lessons & No-Shows: If a student fails to attend a scheduled lesson and does not notify us through the portal or email, the lesson is considered a no-show. No-shows are forfeited and not eligible for makeups, credits, or rescheduling.

2.2 Early Cancellations (More than 48 Hours’ Notice):

• Makeup lessons are issued and can be used with any teacher at any location.

• Makeup lessons are self-scheduled through the student portal, up to 10 days in advance.

• Makeup lessons can only be used with an active subscription with weekly lessons

• Makeup lessons are valid for 60 days and can be scheduled directly from your portal

• Makeups cannot be used in lieu of regular lessons nor can weekly lessons be placed on hold for makeup lesson use.

• Makeup lessons cannot be applied as credits toward future payments, nor can they be refunded in cash for their original value or cost.

• Makeup lessons cannot be rescheduled once booked and are forfeited if missed or canceled

• If membership is canceled with 30 days’ notice, any unused makeup lessons expire at the same time.

Billing

Lessons are billed monthly on the 1st of each month. The number of lessons per month may vary depending on the number of days in the month and holidays.

• If you start lessons mid-month, your first bill will be on the day of your first lesson, then on the 1st of each month thereafter.

• Billing is calculated based on scheduled lessons, considering holidays and the total number of lesson days each month.

- All lesson payments are non-refundable. We do not provide refunds or partial credits for missed lessons, cancellations mid-month, or unused makeup credits.

• Our studios follow the Alberta provincial bank holiday schedule, meaning we are closed on these holidays, and no lessons or billing will apply. However, we remain open on some “optional holidays.” Please check your student portal for details on your upcoming schedule.

-Non-Payment & Account Suspension:

If a scheduled payment fails or is declined, the account will be considered past due. We reserve the right to immediately suspend access to lessons, makeup credits, or account features during any period of non-payment or unresolved balance. Missed lessons during a suspension are not eligible for makeup, refund, or credit. Standard billing continues unless a formal 30-day cancellation is submitted in writing.

3.1 Payment Authorization & Chargeback Policy

By enrolling in lessons and submitting payment, the Policy Holder agrees to the following:

• The Policy Holder is the individual who enrols the student and provides the payment method.

• The Policy Holder accepts full financial responsibility for all charges on the account.

• Only the Policy Holder may authorize cancellations, billing changes, or payment updates.

Third-Party Card Use:

If a third-party card (e.g., spouse, ex-partner, grandparent) is used for payment, that cardholder is deemed to have authorized the transaction and accepts all terms. Enrolments made on behalf of a minor or family member do not limit this liability.

Account Responsibility Is Non-Transferable:

Financial and contractual responsibility for an enrolled student remains with the original Policy Holder unless formally transferred and approved in writing by Cowie Holdings Inc. Payment method changes, family separation, or third-party disputes do not automatically transfer this responsibility.

Shared Custody & Third-Party Payments:

In situations involving shared custody, split households, or where a third-party card is used (e.g., spouse, ex-partner, grandparent), the enrolling Policy Holder remains fully responsible for all payments. Disputes between household members or claims of unauthorized use do not void financial responsibility. Any chargebacks initiated by a third party will be considered unauthorized and in breach of this agreement.

Payment Consent & Legal Agreement:

Enrolment through our portal or payment page is logged with a digital timestamp, IP address, and user ID. These records serve as proof of agreement and authorization to charge the card on file. By submitting payment, the payer enters into a binding agreement for music instruction services with Cowie Holdings Inc., regardless of who attends the lessons.

Disputes or disagreements regarding service delivery, billing, or cancellation do not pause or suspend the terms of this agreement. All scheduled payments and service obligations continue unless a formal cancellation is submitted in writing with 30 days' notice.

Lesson Fulfillment:

A lesson is considered valid and billable if it is:

Attended in person or online.

Canceled late by the student.

Missed without notice (no-show).

Delivered via LessonMate or other video platform.

Taught by a qualified substitute.

Available to the student during the scheduled time, regardless of whether they attend or access the lesson.

Disputes & Chargebacks:

Initiating a chargeback for services that were validly delivered (per the terms above) is considered a breach of this agreement.

In such cases, Cowie Holdings Inc. may:

• Suspend services immediately,

• Apply a $50 administrative dispute fee,

• Submit all enrolment, communication, and service records to the payment processor,

• Pursue recovery through collections if the balance is not resolved within 30 days,

• Unpaid balances unresolved after 60 days may be referred to a third-party collections agency and may be reported to credit bureaus.

By agreeing to these terms, the Policy Holder waives the right to seek a refund through third-party financial institutions (e.g., credit card chargebacks) for services rendered in accordance with this agreement. Refund attempts via chargeback that contradict these terms may result in legal or financial recovery actions.

These payment terms form part of a binding legal agreement enforceable in Alberta under the jurisdiction of Cowie Holdings Inc. If Cowie Holdings Inc. is required to pursue legal action or engage a collections agency to recover unpaid balances, the Policy Holder agrees to reimburse all reasonable associated costs, including legal fees, court filing fees, and administrative collection costs.

4. Health and Safety

Students showing signs of illness (coughing, sneezing, runny nose, sore throat, or chest discomfort) are requested to cancel in-person lessons and opt for a video lesson (LessonMate) instead.

• Instructors may ask sick students to wait in the lobby. A video lesson (LessonMate) will then be provided.

4.1 Teacher Assignments & Substitutes

The music academy reserves the right to change a student’s teacher temporarily or permanently if the originally assigned instructor is unavailable due to illness, vacation, scheduling changes, or resignation.

• Substitute teachers may be assigned without prior notice.

• Teacher changes do not qualify for refunds, credits, or makeups, as long as the lesson is delivered by a qualified instructor.

• All instructors meet our academy’s training and screening standards and follow our standardized curriculum and teaching methods.

• We do our best to ensure continuity and fit between students and instructors, but occasional teacher changes are a normal part of studio operations.

We appreciate your flexibility in these rare situations and are committed to making every teacher transition as smooth and positive as possible.

4.2. Emergency Closures

The academy reserves the right to cancel or reschedule lessons due to emergencies, public health orders, power outages, extreme weather, or facility-related issues. In such cases, a LessonMate video or a makeup lesson may be offered. Refunds will not be provided.

5. Hold Harmless Agreement

By enrolling in lessons at Cochrane Music Academy, Chestermere Music Academy, Beaumont Music Academy, Notable Music Academy, Fort Sask Music Academy or any other Academies owned by Cowie Holdings Inc., you agree to the following:

• Participation involves risks (e.g., physical strain, repetitive motion injuries). You voluntarily assume all risks.

• You release and hold harmless the academies, Cowie Holdings Inc., their owners, instructors, employees, and representatives from any claims, liabilities, or expenses related to participation, except in cases of gross negligence or intentional misconduct.

• The academy is not responsible for lost, stolen, or damaged property. To the fullest extent permitted by law, Cowie Holdings Inc. and its affiliates are not liable for indirect, incidental, or consequential damages related to participation in lessons or academy activities, including but not limited to missed lessons, injuries, or scheduling disruptions.

6. Terms of Use & Policy Changes

Cowie Holdings Inc. reserves the right to update or modify its policies, terms, and procedures at any time to reflect changes in business operations, staffing, regulations, or other circumstances.

Any changes will be published on the student portal or communicated via email. Continued enrolment after such updates constitutes acceptance of the new terms. While we strive to provide advance notice when possible, changes may take effect immediately if required. All communications sent to the Policy Holder via email, text, or the student portal are considered delivered. Failure to read, open, or respond does not exempt the Policy Holder from compliance with these terms.
